A. Instructions on the Right of Withdrawal

Introduction

Consumers have a right of withdrawal as set out below. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

Important Notice Regarding Personalized Goods

Under Section 312g(2), point 1 of the German Civil Code (BGB), there is no statutory right of withdrawal for goods made to your specifications or clearly tailored to your personal needs. This applies in particular to items personalized with names, individual details, your own text or photos. This exclusion applies regardless of whether production has already begun.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason, unless the right of withdrawal is excluded under Section 312g(2), point 1 of the German Civil Code (BGB) (see the section below).

The withdrawal period is fourteen days:

• from the day on which you, or a third party designated by you other than the carrier, acquire physical possession of the goods, if you ordered one or more goods in a single order and they are delivered together;

• from the day on which you, or a third party designated by you other than the carrier, acquire physical possession of the last item, if you ordered multiple goods in a single order and they are delivered separately;

• from the day on which you, or a third party designated by you other than the carrier, acquire physical possession of the last lot or piece, if you ordered goods delivered in multiple lots or pieces.

To exercise your right of withdrawal, you must inform us (F & F Commerce GbR, represented by its partners Patrick Flöter and Mohammadreza Farahanirad, Am Stöckener Bach 18, 30419 Hannover, Germany; email: support@fandfcommerce.com; telephone: +49 177 7593751) of your decision to withdraw from this contract by an unequivocal statement, such as a letter sent by post or an email. You may use the model withdrawal form provided below, but this is not mandatory. You may also exercise your right of withdrawal online using our electronic “Withdraw from contract” function.

If you use the electronic withdrawal function, we will promptly send you an acknowledgment of receipt on a durable medium, such as email, containing the details of your withdrawal statement and the date and time it was received.

To meet the withdrawal deadline, it is sufficient to send your communication concerning the exercise of your right of withdrawal before the withdrawal period expires.

Effects of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs, except for any additional costs arising from your choice of a delivery method other than the least expensive standard delivery offered by us. We will make this reimbursement without undue delay and no later than fourteen days after the day on which we are informed of your decision to withdraw from this contract. We will use the same means of payment that you used for the original transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is earlier.

You must send back the goods or hand them over to us without undue delay and, in any event, no later than fourteen days after the day on which you inform us of your withdrawal from this contract. The deadline is met if you send back the goods before the fourteen-day period expires.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

Exclusion of the Right of Withdrawal

Under Section 312g(2), point 1 of the German Civil Code (BGB), the right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and whose production is determined by an individual choice or decision made by the consumer, or that are clearly tailored to the consumer’s personal needs.

This applies in particular to goods personalized according to your specifications with names, dates, text or photos. This exclusion applies regardless of whether production or personalization has already begun.

Please check your personalization details carefully before completing your order. You will be expressly informed of this exclusion of the right of withdrawal during the ordering process.

The right of withdrawal also expires early in the following cases:

• contracts for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene, if they have been unsealed after delivery;

• contracts for the supply of goods that, after delivery, have become inseparably mixed with other items due to their nature;

• contracts for the supply of sealed audio or video recordings or computer software, if they have been unsealed after delivery.
